Parking management_DSGVO notes

This notice describes how we [Annaberger Liftbetriebs-Gesellschaft m.b.H., Annarotte 126, 3222 Annaberg] process your personal data in connection with our parking management (pursuant to Art 13 (1) DSGVO).

1. purposes of the data processing

We will process your personal data for the following purposes:
(a) parking management including automating and expediting the service for vehicles for which a parking ticket has been booked).
c) Control of parking regulations (e.g. parking over two parking spaces)
d) Control of the legally compliant use of the parking ticket (e.g. exceeding the permitted parking time)
e) Protection of facilities (e.g. vandalism)
f) Documentation, investigation and prosecution (law enforcement) of misuse of parking spaces (e.g. use of parking spaces without payment)
g) Re-parking of motor vehicles

We collect this data by means of:

  • of the data provided by you for the creation of the contract (Personalised Day Ticket in conjunction with the parking ticket).
  • the vehicle registration number entered by you when purchasing the day ticket or announced at the day ticket office
  • Evaluation of the number plate data

Reference is made to image recording and the collection of licence plate data in accordance with the legal requirement

2. legal bases of the processing

  • For the billing of parking fees in connection with the parking ticket, the legal basis is the fulfilment of the contract (Art. 6 para. 1 lit. b DSGVO)
  • For the registration of licence plates in connection with our parking management, the legal basis is the legitimate interest of the data controller (Art. 6 (1) (f) of the DSGVO), which is to achieve the purposes mentioned above under point 1 (a) to (g). You have the right to object to this data processing in accordance with Art. 21 (1) DSGVO if you have reasons arising from your particular situation.
  • For the recognition of individual number plates to automate and accelerate the service for whitelisted vehicles, the legal basis is the legitimate interest of the controller (Art. 6 (1) lit. f DSGVO), which is to implement our parking management efficiently.

3. storage time

a) Customer data:
Your personal data will only be retained by us for as long as is necessary for the performance of the contract in order to achieve the purposes set out in point 1:

b) Image processing ("video surveillance"):
Recorded data (number plates) are deleted after 48h at the latest, unless they are required for a specific reason for the realisation of the underlying purposes of protection or preservation of evidence.

In principle, we try to store as little as possible. Normally, only for the time that a licence plate is present. I.e. entry -> entry exit -> then the number plate is deleted.
In control cases, this is buffered to 24 so that the movements can also be traced. So -> Entry capture -> Exit capture + 24 hours -> then the licence plate is deleted.
In the event that a licence plate does not move out, there is a definable maximum parking period. Here, 48 hours are stored. This means that a licence plate that has not exited by then, or where the exit has perhaps not been recognised, only remains in the system for 48 hours.
The only exceptions are "registered" number plates (long-term parkers, employees) and number plates with a still valid ticket (see Data Protection Shop). Long-term parkers remain stored indefinitely until revoked, those with a ticket of course for as long as the ticket lasts, including the rules mentioned above.

Personal data, including vehicle registration numbers, which are collected and stored by the data controller in the course of the user's requested re-parking of his motor vehicle or parking without a parking ticket, are deleted immediately as soon as the purpose of the processing (legitimate interest of the data controller in documentation, investigation and legal enforcement, such as in particular civil law suits, as well as legal defence against claims for damages) is fulfilled and no statutory retention period prevents premature deletion.
